Terms of Service

These Terms of Service ("Terms") govern your access to and use of Ada AI SDR ("Ada", "we", "us"), an AI-powered outbound sales automation platform operated from Türkiye. By creating an account or using the service, you agree to these Terms.

1. The service

Ada provides tools for prospecting, drafting outbound email sequences, running voice call campaigns, managing replies, and related sales automation. Features may change over time.

2. Eligibility & accounts

You must be at least 18 years old and authorized to bind your organization. You are responsible for activity under your account and for keeping credentials confidential.

3. Acceptable use

• No spam, unlawful, deceptive, or harassing outreach.
• No sending to recipients who have opted out or who are on suppression lists.
• You must comply with all applicable laws, including data protection, anti-spam (e.g. GDPR, KVKK, CAN-SPAM), and telemarketing regulations (e.g. TCPA).
• No attempts to reverse engineer, resell, or overload the service.

4. Third-party data (email & phone)

Ada uses third-party APIs and data providers to source, verify, and enrich prospect data, including email addresses and phone numbers. We do not own this data and provide it "AS IS", without warranty of accuracy, completeness, deliverability, or legal compliance. We disclaim any liability arising from the use of such third-party data. You are solely responsible for how you use it and for complying with all applicable laws in your jurisdiction and in the recipient's jurisdiction.

5. Customer content

You retain ownership of content you upload (materials, samples, lists, prompts). You grant us a limited license to process it in order to provide the service.

6. Billing

Paid plans are billed in advance via our payment provider. Fees are non-refundable except where required by law. You may cancel at any time from the Billing page; cancellation takes effect at the end of the current billing period.

7. AI outputs

AI-generated drafts, summaries, and suggestions may be inaccurate. You are responsible for reviewing outputs before sending or acting on them.

8. Disclaimers

The service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant deliverability of emails, connectivity of phone calls, or accuracy of any third-party data.

9. Limitation of liability

To the maximum extent permitted by law, Ada shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, or goodwill. Our total aggregate liability shall not exceed the amounts you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold Ada harmless from any claims arising out of your use of the service, your content, or your violation of these Terms or applicable law, including claims by recipients of your outbound campaigns.

11. Termination

We may suspend or terminate your access if you breach these Terms or use the service in a manner that risks harm to us, other users, or recipients.

12. Governing law

These Terms are governed by the laws of the Republic of Türkiye. The courts of Istanbul shall have exclusive jurisdiction over any disputes, without prejudice to mandatory consumer protection rules of your country of residence.

13. Changes

We may update these Terms. Material changes will be communicated via the service or email. Continued use after changes take effect constitutes acceptance.
